If this provision is observed to generally be unlawful or unenforceable, then neither Party will elect to arbitrate any Dispute slipping within just that part of this provision observed to be unlawful or unenforceable and these types of Dispute shall be resolved by a court of proficient jurisdiction within the courts detailed for jurisdiction above
